You agree that you will useTara CompuNET in compliance with all applicable local, provincial, national, and international laws, rules and regulations. Furthermore, you agree that you will not ask questions that are unlawful, defamatory, harassing, abusive, fraudulent, obscene, intended to advertise or sell goods or services, or are otherwise objectionable. You further agree not to ask questions designed to elicit responses that relate to illegal activity or that infringe upon another party's intellectual property rights. You may not sell, use, reproduce, modify, edit, translate, publish, perform, display, post, transmit and distribute questions, comments or answers for any public or commercial purpose without the express written permission of Tara CompuNET. Tara CompuNET does not necessarily edit, screen, filter, modify, or otherwise monitor the content of questions or comments in advance of responses.Tara CompuNET takes no responsibility for third party content, nor doesTara CompuNET have any obligation to monitor such third party content.Tara CompuNET reserves the right to refuse service to anyone at any time without notice for any reason.Tara CompuNET will not be responsible or liable for the exercise or non-exercise of its rights under this Agreement.
Warranty
The information provided byTara CompuNET pursuant to this Service is derived from private and public reference sources as well as personal knowledge and is provided byTara CompuNET or independent contractors ("Technicians") to assist you. The Information has not been verified, however, and neitherTara CompuNET nor Technician represent that it is accurate, correct, complete, reliable, or otherwise valid.Tara CompuNET does not endorse or recommend, and expressly disclaims liability for any product, manufacturer, distributor, service or service provider mentioned in any question, comment or answer. FurtherTara CompuNET does not endorse or support any opinion expressed in a question, comment, or answer. The information and service is provided "as is" with no warranty of any kind and you use the service at your own risk. The contact of the questions, answers, and comments is provided by and is the responsibility of the person claiming such items. Tara CompuNET and their Technicians expressly disclaim any warranty, express or implied, regarding the service, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.
Limitation of Liability
Under no circumstances will Tara CompuNET or Technicians be liable to you for any indirect, incidental, consequential, special or exemplary damages arising out of or in connection with use of the service whether or notTara CompuNET or their Technicians have been advised of the possibility of such damages. Under no circumstances shallTara CompuNET or their Technicians be liable to you for any amount for services rendered or information provided pursuant to this agreement, rather your sole and exclusive remedy shall be the refund of fees actually paid by you toTara CompuNET for any instance of use of the services that gives rise to a claim. To the extent that any questions, comments, or answers refers to any product, manufacturer, distributor, company, service, or service provider,Tara CompuNET expressly disclaims any association with, endorsement of, or liability for any such product, manufacturer, distributor, company, service, or service provider.
Hold Harmless and Indemnity
You agree to hold harmless and indemnifyTara CompuNET, and its Technicians, employees, agents and representatives, from and against any third party claim arising from or in any way related to your use of the Service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature. In such a case,Tara CompuNET or the affected Technician(s) will provide you with written notice of such claim, suit or action.
Release and Waiver
To the maximum extent permitted by applicable law, you hereby release, and waive all claims againstTara CompuNET and its employees and agents from any and all liability for claims, damages (actual and consequential), costs and expenses (including litigation costs and attorneys' fees) of every kind and nature, arising out of or in any way connected with use of the Service.
Payment:
If a customer has an out standing balance with Tara CompuNET, we reserve the right not to service the client until the balance is paid in full. New and upgraded computer or hardware parts require payment upfront. Per hour jobs will be billed at the end of the job. You may pay the technician onsite with a check made out to Tara CompuNET. Per hour jobs have ten days to be paid in full unless otherwise arranged. Payments can be made by credit card via PayPal. Client agrees that failure of payment to be received by Tara CompuNET within 15 days of the due date may result in the interruption of services provided. Such interruption does not relieve the Client from the obligation to pay the monthly services charge. All returned checks will be liable for a $49.00 charge. Accounts in default are subject to a late payment charge of $19.00 per late payment and an interest charge of 2% per month on the outstanding balance. If the client defaults, the client agrees to pay Tara CompuNET its reasonable expenses, including attorney and collection agency fees, incurred in enforcing its rights under this agreement. Upon account interruption the client's files, information, and mail under the client's account will be preserved, but will not be accessible, for up to 30 days after the interruption date. If payment is not received with-in this 30 day period, Tara CompuNET has the right to delete or resell these files, data, information and mail. Tara CompuNET has the right to suspend service to the client at any time for any reason. This is of course for the protection of Tara CompuNET and it's other clients. If such a suspension is to last for more than 1 day, the client will be notified as to the reason by e-mail.
Tara CompuNET will not be held liable or responsible for any sort of data loss on any computer system or media device. It is the sole responsibility of the customer to ensure all his/her data is safe on BACKUP prior to any diagnostics & or any service related work. If your data is not backed up prior to pick-up or drop-off & would like us to back up the data for you, there will be an additional fee of $45.00 per CD. Please check your equipment thoroughly as Tara CompuNET is not liable for any lost or damaged parts after the equipment has left our facility. Tara CompuNET will not be held liable for any lost or damaged software/hardware left behind to assist in a diagnostic or repair of your equipment that you HAVE NOT made note of above. In order to proceed with any Operating System re-installation, the customer must provide us with a valid certificate of authenticity for that operating system; Tara CompuNET holds the right to refuse service at their discretion. Tara CompuNET regular labor rate is $75/hr, and 50% additional on the regular hourly rate is applied for off hours and weekend service rates. Regular hour is defined as 9 am to 5 pm Eastern Standard Time, Monday to Friday. Tara CompuNET is not liable for any equipment damage or software/data loss due to lightning, hail, floods or any acts of god.
